The Policy

Each person has the right to the protection of his or her personal data. iDesign S.r.l., as an autonomous operator respects the privacy of its Users/Customers and their right to be informed about the collection and processing of their personal data. The personal data of Users/Customers (by way of non-exhaustive example: First Name, Last Name, Address, Mail, Phone Number) will be collected when registering on the Site, or when placing an order or during contact with Customer Care. The data will be processed by iDesign S.r.l. in order to allow registration to the Site, identification of Users/Customers, management of personal accounts, collection and fulfillment of orders, delivery of ordered products, processing of payments or provision of a service (such as Customer Care assistance in case of questions or return requests) and, upon express request, the sending of the newsletter and, more generally, information and/or material of a commercial or promotional/advertising nature relating to our products, events and services as well as to access promotional or special benefits and initiatives, sales campaigns via e-mail sms, mms, telephone or postal communications, as well as through subscription to social networks with the necessary management of the relevant databases.

This information may also be used to ask for feedback on the Site and the services offered and, in particular, to send surveys to detect and evaluate the degree of satisfaction of Users/Customers about the quality of the products in order to adapt our communications and commercial offers to the tastes and needs of Users/Customers to make them more interesting and appreciable.

Data about Site consultation, browsing and sales may also be collected for statistical purposes, and this information may be transferred to selected third parties. Personal data may also be used for internal marketing and purchasing behavior studies, along with non-personal data to analyze and profile and monitor User/Customer preferences in order to improve our products and services, to better understand what may be of most interest to our Users/Customers.

In addition, for mere service quality control purposes and for training purposes, we may monitor or record communications forwarded to us.

Any use of data related to credit cards, and more generally related to means of payment, for purposes other than the verification of the existence of means of payment, the charging and processing of payments, and the handling of any complaints and litigation proceedings is explicitly excluded. For this purpose, the aforementioned data will also be processed by the provider that provides services related to the management of online payments as well as by the institution that issued the credit card used to validate the order.

Who processes the data, how and for what purposes

iDesign S.r.l. with registered office in Via Helsinky 29, 00144 Rome (RM), Italy, tax code, VAT number and registration number with the Register of Companies of Rome 12137741000 is the owner of the personal data of Users/Customers and processes the data according to the purposes indicated from time to time on the site on the same page where the data are conferred. The company iDesign S.r.l. is the company that directly sells in its own name the products on the Site, carrying out, among other things, sales management activities such as administration, collection, product delivery and customer care. For the performance of the aforementioned activity iDesign S.r.l. processes as an autonomous Data Controller and in accordance with the applicable privacy law the data of the users such as name and surname, residence and information related to the credit card used by the users (e.g. name and surname of the card holder, number, expiration date, security code).

The processing of personal data of Customers/Users who visit and consult the Site is limited to . browsing data, i.e., data whose transmission to the site is implicit in the operation of the computer systems responsible for managing the Site and in the use of the communication protocols proper to the Internet. Navigation data are, for example, the IP addresses or domain names of the computers used by users who connect to the Site and other parameters relating to the type and computer operating system used by users. For more information regarding navigation data, we invite you to consult the Cookies Policy. iDesign S.r.l. also collects and processes personal data provided voluntarily by the User/Customer or otherwise acquired, including from third parties, in the course of its activities. Personal data may be voluntarily provided by the User/Customer when the User interacts with the Site's functionalities and requests the services offered by the Site, for example in case of registration to the Site, or initiatives offered through the Site, in case of request for information or informative material to iDesign S.r.l. or sending to iDesign S.r.l. a communication by traditional mail or through the Site. iDesign S.r.l. may use the User/Customer's personal data to assert or defend a right in court and to comply with obligations provided for by laws, regulations and EU legislation.

With the user's consent, which is free and optional, iDesign S.r.l. may also process user data for purposes of individual and group profiling (profiling) and for marketing purposes, i.e. to send the User/Customer, including via newsletter, electronic mail (e-mail), sms and mms, information and updates on products and offers, exclusive sales, promotional campaigns and on events and similar initiatives organized by iDesign S.r.l. or in which iDesign S.r.l. participates, including any invitations to such events. The User/Customer will always have the opportunity to object to the processing of their personal data for the purpose of sending promotional information via e-mail; in each communication there will be a specific section specifying how to object to the processing and no longer receive promotional materials and information.

In the specific sections of the Site where the data are collected, a special notice prepared in accordance with Art. 13 of the Privacy Code is published. When necessary under the Privacy Code iDesign S.r.l. requires the user's consent before proceeding to the processing of personal data.

IDesign S.r.l. decides the purposes and methods of data processing and the tools to be used, also with regard to the security profile.

For exclusively organizational and functional needs, with purposes strictly connected and related to the provision of services on the Site, the data of Users/Customers may be transmitted to external companies called "Data Processors" who carry out certain activities such as, but not limited to: the fulfillment of orders, the processing and transmission of orders, the monitoring of payments and the shipment of products sold. These companies have been chosen because they have proven to have capacity, experience and reliability, and to provide suitable guarantees in full compliance with the current provisions on the processing of personal data, including the profile on data security in accordance with the modalities defined with iDesign S.r.l.

The data transmitted to the "Data Processors", will in any case be only those strictly necessary for the performance of their activities. It will not be given to such companies to use the data for different purposes.

Personal data are processed mainly in electronic format and in some cases also in paper format, such as when data processing is necessary to prevent fraud on the Site.

Personal data will be stored in a form that allows the identification of Users/Customers within the limits of the law. In order to ensure that personal data is always accurate, up-to-date, complete and relevant, we invite our Customers/Users to report any changes that have occurred to our Customer Care via the following Form.

Except as otherwise provided herein, personal data will not be disclosed to third parties for purposes not permitted by law or without the express consent of our Users/Customers.

Data may be disclosed to law enforcement or judicial authorities, for example as part of the Site's anti-fraud services, in accordance with legal requirements and when requested.

iDesign S.r.l. ensures that the transfer of personal data to countries that do not belong to the European Union and that do not ensure adequate levels of protection, will be carried out only after the conclusion between IDesign S.r.l. and said subjects of specific contracts, containing adequate safeguard clauses for the protection of personal data, in accordance with applicable law and regulations.

It may happen that iDesign S.r.l. processes personal data of third parties communicated directly by its Users/Customers, e.g., when Users/Customers intend to refer a friend to a service or product for sale on the Site or when Users/Customers purchase a product to be delivered to a friend or when the person paying the purchase price is different from the person to whom the product is shipped.

In the aforementioned cases, the User/Customer is invited to obtain the consent of the person to whom the data refers before communicating it to iDesign S.r.l., and to inform him/her of this Privacy Policy because he/she will be the one and only person responsible for the communication of information and data related to third parties, without their express request, and for their incorrect or unlawful use. In any case, iDesign S.r.l., within the limits of what is prescribed by the regulations, will fulfill the obligation of information to the reported user and, where necessary, will request express consent, at the time of registration in their own personal data.

Failure to provide personal data and consequences

iDesign S.r.l. each to the extent of its competence, adopt the necessary security measures in order to minimize the risks of destruction or loss, even accidental, of the data themselves, of unauthorized access or processing that is not permitted or does not conform to the purposes of collection indicated in our Privacy Policy. However, as it is not possible to guarantee that the measures taken for the security of the Site and the transmission of data and information on the Site itself will limit or exclude any risk of unauthorized access or dispersion of data, we invite our Users/Customers to ensure that their computers are equipped with up-to-date antivirus software for the protection of network transmission of data, both incoming and outgoing, and that the Internet service provider has adopted firewalls and spam filters or other suitable measures for the security of network transmission of data.

Right of access to data and contacts

The User/Customer always has the right to obtain confirmation of the existence or non-existence of personal data concerning him/her, even if not yet registered, and their communication in an intelligible form. He/she also has the right to obtain information about the origin of the personal data, the purpose and method of their processing, the logic applied in the event of processing carried out with the aid of electronic instruments, the identification details of the data controller and data processors, and the names of the persons or categories of persons to whom the personal data may be communicated or who may become aware of them in their capacity as, for example, data processors or persons in charge of processing. The User/Customer always has the right to obtain from iDesign S.r.l.:

• the updating, rectification or, or integration of personal data;
• the cancellation, transformation into anonymous form or the blocking of personal data, possibly processed in violation of the law, including those whose storage is not necessary in relation to the purposes for which the data were collected or subsequently processed;
• certification that the above operations have been brought to the attention, also as regards their content, of those to whom the data were communicated or disseminated, except where this proves impossible or involves a manifestly disproportionate to the protected right.

The User/Customer has the right to object in whole or in part:

• for legitimate reasons, to the processing of personal data concerning him/her, even if pertinent to the purpose of collection;
• to the processing of personal data concerning him/her for the purpose of sending advertising material or commercial communications;
• to the processing of personal data for the fulfillment of market research and analysis on preferences and purchasing behavior.
